Pethe Sara Simao appeared in the Protea Magistrates Court on Monday, 27 January.

MURDER accused Pethe Simiao appears in court. 

He is accused of raping and murdering six-year-old Amantle Samane in Orlando, Soweto.

Facing charges of kidnapping, rape, and murder, and violating the Immigration Act, the Mozambican Simiao appeared in the Protea Magistrates Court on Monday, 27 January, via AVR.  

This after the 25-year-old abandoned his bail application during his previous appearance.

Representing the accused, Advocate Ndivhuwo Masindi said he was disappointed to learn that the decision from the Director of Public Prosecutions (DPP) was not ready.  

“On the previous appearance, we postponed the matter for the decision from the DPP as to whether the matter will remain in regional court or will go to High Court,” he said. 

Masindi added that the accused is now being prejudiced due to unnecessary delay.

“I really don’t understand because the last time when we were here, it was on the 3rd of December, which means it’s almost a month and a half just for taking a DPP decision and also the issue of dockets in court, not before the court,  because the state stays with the docket and the state knew that the matter is coming to court today (Monday) but no docket, no decision. 

NPA spokeswoman Phindi Mjonondwane said the state is confident about the case.

“We took the decision as NPA that the accused before the court must be persecuted.” 

The postponement has angered community members. 

“Our government fails us dismally in all factors. A child was brutally raped and killed by a foreign national. He is having a nice time in prison and eating nice food while a child has died. My question is why South Africa doesn’t have a law that deals with foreigners. They should be persecuted,” said an angry community member. 

The matter was postponed to 24 February for the DPP’s decision. 

Amantle’s body was found in a shack not far from her home in October 2024, partially dressed.
